NOTICE: Effective February 1, 2017, this office will no longer accept the "Pay at Court" option at NYSCEF. All payments for filing MUST be paid via credit card at the time of filing with NYSCEF.

As of Tuesday, October 1, 2013, under Chapter 184 of the laws of 2012, which authorizes mandatory e-filing in Erie County Supreme Court, will continue conversion from consensual to mandatory e-filing of court matters by expanding the types of cases now required to be electronically filed.

Erie County Clerk Kearns advises that the new case types will be accepted through NYSCEF effective October 1, 2013 and includes all case types except Article 78 Proceedings, Matrimonial Actions, Mental Hygiene matters and action based upon Election Law.

Erie County is one of nine counties, out of sixty-two, in the state requiring cases be filed electronically through NYSCEF. The Erie County Clerk’s Office worked closely with Judge Paula Feroleto, Administrative Judge for New York’s 8th Judicial District, on this project and has partnered in numerous educational outreach efforts for local attorney’s to prepare them to the transition to electronic filing.

The New York State Unified Court System has established “NYSCEF” a program that permits the filing of legal papers by electronic means with the County Clerk and the courts in certain case types in designated venues, as well as electronic service of papers in those cases.

If you have questions about e-Filing or regarding specific actions, please contact the Erie County Clerk's Actions and Proceedings office at (716) 858-8785, option #2 or e-mail to
