Texas Man Pleads Guilty for Raping Child in Orchard Park

Erie County District Attorney John J. Flynn announces that 28-year-old James Q. Carollo of Crosby, Texas pleaded guilty yesterday morning before State Supreme Court Justice Deborah A. Haendiges to one count of Rape in the First Degree (Class “B” violent felony). The defendant pleaded guilty to the highest count in the indictment against him. 

Between on or about July 7, 2020 and on or about September 10, 2020, the defendant forcibly engaged in sexual intercourse with a child who was less than 14-years-old. The crime occurred at a location in the Village of Orchard Park. The defendant was known to the victim. 

Carollo was arrested on the indictment warrant in mid-July in Houston, Texas. On Tuesday, August 1, 2023, the defendant was returned to Western New York after he waived extradition.

Carollo faces a maximum of 25 years in prison when he is sentenced on January 23, 2024 at 2:00 p.m. He continues to be held without bail.  A temporary order of protection, issued on behalf of the victim and the victim’s mother, remains in effect. 

DA Flynn commends Detective Darryl Purucker and Town of Orchard Park Police Department as well as the Harris County Sheriff’s Office for their work in this investigation.  

The case was prosecuted by Assistant District Attorney Meredith M. Mohun of the Special Victims/Domestic Violence Bureau.
