Erie County District Attorney Michael J. Keane announces that Edward K. Tutuska, 30, of Orchard Park, was sentenced this morning before State Supreme Court Justice Betty Calvo-Torres to 13 years in prison followed by 10 years of post-release supervision. He will be required to register as a sex offender upon his release.
Between on or about March 1, 2023, and March 15, 2024, the defendant engaged in multiple acts of sexual conduct with a child who was less than eleven years old at a location in the Town of Orchard Park. The defendant, who was known to the victim, acted in a manner likely to be injurious to the physical, mental or moral welfare of the victim.
On March 16, 2024, the defendant subjected another child, who was less than eleven years old, to sexual contact. The crime occurred at the same location in the Town of Orchard Park. The defendant knowingly acted in a manner likely to be injurious to the physical, mental or moral welfare of the victim. The defendant was also known to the second victim.
In February 2025, a jury found Tutuska guilty of one count of Course of Sexual Conduct Against a Child in the Second Degree, one count of Sexual Abuse in the First Degree (Class āDā felonies) and two counts of Endangering the Welfare of a Child (Class āAā misdemeanors). Jurors rendered their decision after less than two hours of deliberation following a nearly six-day trial, convicting the defendant of all counts of the indictment.
Today, final orders of protection were issued on behalf of the victims, which remain in effect until 2065.
