Lancaster Woman to Serve Weekends in Jail for Refusing to Release Injured Dog Back to Owner

Erie County District Attorney John J. Flynn announces that 47-year-old Andrea L. White of Town of Lancaster was sentenced this afternoon before Lancaster Town Court Justice Anthony J. Cervi to four weekends of incarceration and three years of probation.

On July 18, 2022, the victim hired the defendant to board his dog at her home on East Home Road in the Town of Lancaster. The defendant agreed to care for the dog, a mixed breed terrier named “Nyxxi,” until August 1, 2022. When the victim returned to town and attempted to pick up “Nyxxi,” the defendant refused to release his dog to him.  

On August 5, 2022, the victim again attempted to pick up his dog from the defendant’s home. The defendant told the victim that his dog had escaped from her vehicle during a collision in the Town of Orchard Park. The victim reported the incident to police. The Town of Lancaster Police Department obtained a search warrant for the defendant’s residence. Investigators found several dogs inside of the home, including an injured “Nyxxi.”  

“Nyxxi” was taken to an emergency veterinarian office where she was treated for a fractured and dislocated left forearm, a laceration on her neck and missing teeth.

White pleaded guilty to one count of Overdriving, Torturing and Injuring Animals; Failure to Provide Proper Sustenance (Class “A” misdemeanor under New York State Agriculture and Markets Law), the highest sustainable charge, on May 16, 2023.

As part of her sentence today, White was ordered to pay $1,402.23 in restitution. Also, a final no contact order of protection was issued on behalf of the victim. As a provision of her probation, Judge Cervi ordered that the defendant shall not possess, obtain, board, care for or have any animals inside of her residence other than the two dogs that she currently owns.

The case was prosecuted by Assistant District Attorney Mitchell T. Schoellkopf of the Justice Courts Bureau and Assistant District Attorney Christine M. Garvey of the Animal Cruelty Unit.
