Erie County District Attorney Michael J. Keane announces that Nathaniel S. Rivera, 35, of Lake View, was arraigned this morning before Hamburg Town Court Justice Carl W. Morgan on one count of Burglary in the Third Degree (Class āDā felony) and one count of Grand Larceny in the Fourth Degree (Class āEā felony).
It is alleged that on Friday, March 7, 2025, at approximately 9:00 p.m., the defendant unlawfully entered a building on the 2700 block of Lakeview Road in the Town of Hamburg. The defendant is accused of stealing various tools, valued at approximately $1,034.52, belonging to the Town of Hamburg Highway Department and Buildings & Grounds Department.
Rivera is scheduled to return on Tuesday, April 22, 2025, at 10:00 a.m. for a felony hearing. He was released on his own recognizance as the charges are non-qualifying offenses for bail.
If convicted of the highest charge, Rivera faces a maximum sentence of 7 years in prison.

The case is being prosecuted by Assistant District Attorney Krista R. DeAntonis of the Justice Courts Bureau.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
