Erie County District Attorney John J. Flynn announces that 36-year-old Justin Barker of Kenmore pleaded guilty this morning before Erie County Court Judge Sheila A. DiTullio to two counts of Criminal Sexual Act in the Second Degree (Class “D” felonies). The defendant pleaded guilty to the highest counts in the indictment against him.
Between on or about March 2018 and October 2019, the defendant, being 18-years-old or more, engaged in sexual conduct on multiple occasions with another person who was less than 15-years-old. The crimes occurred at locations in the Town of Amherst and City of Buffalo.
Barker faces a maximum of up to 7 years in prison when he is sentenced on Wednesday, February 21, 2024 at 10:00 a.m. He remains released on bail set at $75,000 cash, bond or property.
DA Flynn commends the Amherst Police Department and the New York State Police for their work in this investigation.
