Jury Finds Orchard Park Man Guilty of All Charges for Sexually Abusing Two Children

Erie County District Attorney Michael J. Keane announces that a jury found Edward K. Tutuska, 30, of Orchard Park, guilty of one count of Course of Sexual Conduct Against a Child in the Second Degree, one count of Sexual Abuse in the First Degree (Class ā€œDā€ felonies) and two counts of Endangering the Welfare of a Child (Class ā€œAā€ misdemeanors). Jurors rendered their decision yesterday afternoon after less than two hours of deliberation following a nearly six-day trial, convicting the defendant of all counts of the indictment. 

Between on or about March 1, 2023, and March 15, 2024, the defendant engaged in multiple acts of sexual conduct with a child who was less than eleven years old at a location in the Town of Orchard Park. The defendant, who was known to the victim, acted in a manner likely to be injurious to the physical, mental or moral welfare of the victim. 

On March 16, 2024, the defendant subjected another child, who was less than eleven years old, to sexual contact. The crime occurred at the same location in the Town of Orchard Park. The defendant knowingly acted in a manner likely to be injurious to the physical, mental or moral welfare of the victim. The defendant was also known to the second victim.

Tutuska faces a maximum of 14 years in prison when he is sentenced before State Supreme Court Justice Betty Calvo-Torres on Tuesday, April 8, 2025, at 9:30 a.m. He remains held without bail. Temporary orders of protection issued on behalf of the victims remain in effect.

The case was prosecuted by Assistant District Attorneys Jordana C. Grosodonia and Alexander J. Trunfio of the Special Victims/Domestic Violence Bureau.
