Judge Finds Lancaster Man Guilty of Misdemeanor for Unlawful Possession of Cannabis

Acting Erie County District Attorney Michael J. Keane announces thatErie County Court Judge Sheila A. DiTullio has found 32-year-old David A. Zale, Jr. of Town of Lancaster guilty of one count of Criminal Possession of Cannabis in the Third Degree (Class “A” misdemeanor). Judge DiTullio rendered her decision this afternoon following a two non-consecutive day trial, convicting the defendant of the lesser included offense in the indictment. 

On Friday, February 4, 2022, at approximately 12:09 p.m., members of the Cheektowaga Police Department executed a search warrant at business, operated by the defendant, on the 1300 block of French Road. Police recovered approximately 10 pounds of cannabis from inside of the business.

Today, Zale was sentenced to a one-year conditional discharge.

Acting DA Keane commends the Cheektowaga Police Department for their work in this investigation.   

The case was prosecuted by Assistant District Attorneys Brendan W. Fitzgerald and Andrew S. Criado of the Felony Trials Bureau.
