Judge Finds Defendant Guilty of Assaulting Probation Officer

Acting Erie County District Attorney Michael J. Keane announces that State Supreme Court Justice Debra Givens has found Justin L. Davis, 24, of Buffalo guilty of one count of Assault in the Third Degree (Class “A” misdemeanor). Judge Givens rendered her decision this morning after an approximately three-day, non-jury trial in mid-September.

On Thursday, February 16, 2023, at approximately 11:45 a.m., the defendant was in custody while at the Erie County Probation Department office on Niagara Plaza in the City of Buffalo. A warrant had been issued for his arrest for a violation of probation. The defendant became combative with probation officers while inside of a secure hallway of the building and continued to fight with officers while being escorted out of the building onto Pearl Street. The defendant caused physical injury to a probation supervisor. The incident was captured on surveillance video. 

Davis faces a maximum of one year in jail when he is sentenced on Tuesday, December 17, 2024, at 9:30 a.m. He was remanded pending sentence on the assault case and a violation of probation in a separate case. 

Acting DA Keane commends the Erie County Probation Department for their work in this investigation. 

The case was prosecuted by Assistant District Attorney Mitchell T. Schoellkopf of the Vehicular Crimes Bureau and former Assistant District Attorney Andrew S. Criado.
