Home Improvement Contractor Arraigned on Felony Charge for Scamming Customer in Town of Clarence

Erie County District Attorney John J. Flynn announces that 43-year-old Gregory G. Guzek of Buffalo was arraigned yesterday evening before Clarence Town Court Justice Jonathan D. Hickey on one count of Grand Larceny in the Third Degree (Class “D” felony)

It is alleged that on or about July 12, 2022, the defendant, while working as the owner and operator of Triple G Painting and Restoration, accepted a payment of $18,000 from a customer in the Town of Clarence as part of a signed contract to complete window repairs. The victim allegedly attempted to contact the defendant multiple times after he failed to perform any work or purchase supplies.

Guzek is scheduled to return on Thursday, June 29, 2023 at 5:00 p.m. for a felony hearing. He was released on his own recognizance as the charge is non-qualifying offense for bail.

If convicted of the highest charge, Guzek faces a maximum sentence of 7 years in prison.

“As many residents are hiring contractors during the summer months, I encourage anyone who has been the victim of a home improvement scam to contact my office for further investigation. I take these crimes seriously and any scammer will be prosecuted to the fullest extent of the law,” said Erie County DA John Flynn.

This case is being prosecuted by Assistant District Attorney William E. Szczepanski of the Justice Courts Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
