Gunman Sentenced for Attempting to Injure Victim

Acting Erie County District Attorney Michael J. Keane announces that Devante D. Henley, 32, of Buffalo, was sentenced this morning before State Supreme Court Justice Debra Givens to a determinate sentence of 3 ½ years in state prison followed by 2 ½ years of post-release supervision.

On Friday, December 8, 2023, at approximately 12:10 a.m., the defendant, with the intent to cause serious physical injuries to the victim, fired multiple shots from an illegal pistol at a vehicle in the area of Ship Canal Parkway and Tifft Street in the City of Buffalo. The defendant, who was inside of a vehicle, fled the area after the shooting. The victim was not injured, but his vehicle was hit multiple times by gunfire, resulting in approximately $13,000 in damage. 

Henley pleaded guilty to one count of Attempted Assault in the First Degree and one count of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felonies) on October 17, 2024. The defendant pleaded guilty to the charges in full satisfaction of the indictment. 

Acting DA Keane commends Detective Lon Folts, Detective Robert LaRusch, Det/Sgt. John Losi, Officer Matt Krug and members of the Buffalo Police Department Gun Violence Unit for their work in this investigation and Clarissa Acosta, Victim Advocate with the DA’s Office for her work with the victim.

The case was prosecuted by Assistant District Attorney Ryan M. Flaherty of the Major Crimes Bureau.
