Former Store Manager Sentenced for Stealing More Than $66,000 From Her Employer

Erie County District Attorney John J. Flynn announces that 28-year-old Marshawn Smith of Cheektowaga was sentenced this morning before Erie County Court Justice Sheila A. DiTullio to 5 years of probation.

The defendant admitted to stealing cash from her employer on seventeen separate occasions between April 20, 2022 and August 18, 2022. The defendant, while working as a manager of a store in the Town of Cheektowaga, was responsible for making nightly cash deposits. Over the course of four months, she stole a total of $66,298.00 from the deposit banking bags. The theft was discovered after an internal audit detected a series of cash deposit shortages. All of the short bank deposits occurred during the defendant’s shifts, which was further corroborated by video evidence. 

Smith pleaded guilty to one count of Grand Larceny in the Third Degree (Class “D” felony) in January 2023. 

As part of the plea, Smith signed a Confession of Judgement in favor of her former employer in the amount of $66,298.00. To date, no restitution has been paid to the victim.

DA Flynn commends Lieutenant Daniel Albrecht and Detective Terry Griffin of the Cheektowaga Police Department for their work in this investigation.

The case was prosecuted by Assistant District Attorney Christopher P. Jurusik of the Special Investigations and Prosecutions (SIP) Unit.
