Driver Sentenced for Killing Pedestrian in Hit-and-Run on Broadway in Summer 2017

Erie County District Attorney John J. Flynn announces that 36-year-old D’Mario A. Caesar of Buffalo was sentenced this afternoon before Erie County Court Judge Susan Eagan to the maximum of 7 ½ to 15 years in prison as a second felony offender.

On July 16, 2017, at approximately 3:08 a.m., the defendant was driving a SUV at a high-rate of speed on Broadway in the City of Buffalo when he hit a pedestrian who was crossing the street near Bailey Avenue. The defendant left the scene without reporting the incident to police. The victim, 31-year-old Brandyn Mallory of Buffalo, died later that morning at ECMC.

The defendant’s vehicle was found unoccupied on Broadway near Greene Street, a short distance away from the scene of the crime.

On January 18, 2023, a jury found Caesar guilty of one count of Manslaughter in the Second Degree (Class “C” felony) and one count of Leaving the Scene of an Incident Without Reporting Resulting in Death (Class “D” felony). Jurors rendered their decision after about an hour of deliberation following a 6-day trial, convicting the defendant of all counts in the indictment against him.

His sentence today on the state charges will run consecutive to his sentence in a federal case involving drug and weapons charges, which has been scheduled for Wednesday, April 5, 2023.

The case was prosecuted by Chief Patrick B. Shanahan of the Felony Trials Bureau and Assistant District Attorney Gina M. Gramaglia of the Special Victims/Domestic Violence Bureau.
