Defendant Sentenced for Committing Home Invasion Burglary in City's University Heights Neighborhood

Erie County District Attorney John J. Flynn announces that 56-year-old Stacey Fuller of Buffalo was sentenced this morning before State Supreme Court Justice Betty Calvo-Torres to an indeterminate term of 2 to 4 years in prison. He was sentenced today as a second felony offender. 

On Wednesday, July 27, 2022, at approximately 5:18 p.m., the defendant unlawfully entered a home on Allenhurst Road in the City of Buffalo with the intent to commit a burglary by removing a screen and climbing through a second-floor window. When the defendant went downstairs to the first floor, he encountered the homeowner in the kitchen. The defendant forcibly stole the victim’s property by motioning underneath of his shirt as if he were in possession of a weapon while demanding her purse. The defendant fled after being confronted by the victim’s son. The victim ran out of the home through the front door to a neighbor’s home where she called police.

The defendant, who was not known to the victim, was arrested a short time after the incident. The defendant was found in possession of two bags that belonged to the victim, which contained her safe, personal papers, credit card and jewelry. 

Fuller was arraigned in Buffalo City Court the following morning. He was held without bail. 

Fuller pleaded guilty to one count of Burglary in the Third Degree (Class “D” felony). The defendant pleaded guilty on the morning that jury selection was scheduled to begin in his trial in October 2023. 

Today, a final order of protection was issued on behalf of the victim, which remains in effect for the next 5 years. 

DA Flynn commends Officers Lyana Luciano, Christopher Bauer, Stephen Schulz, Connor Sumbrum and Detective Sgt. Rachael Isch of the Buffalo Police Department for their work in the investigation.

The case was prosecuted by Assistant District Attorneys Nicholas C. Bussi and Kevin R. Brown of the Felony Trials Bureau.
