Acting Erie County District Attorney Michael J. Keane announces that 34-year-old Lamont K. Love of Buffalo was arraigned on Tuesday morning before State Supreme Court Justice Debra Givens on an indictment charging him with one count of Burglary in the Second Degree (Class “C” violent felony) and one count of Criminal Mischief in the Second Degree (Class “D” felony).
It is alleged that during the early morning hours of Tuesday, February 23, 2024, the victim awoke to loud noise in the kitchen of their apartment in the Parkside neighborhood in the City of Buffalo. The victim called police to report the burglary after allegedly finding their window screen and kitchen countertop damaged. Responding police officers allegedly recovered a pair of abandoned shoes and a cell phone, which were placed into evidence. The defendant is accused of unlawfully entering the residence with the intent to commit a crime.
Love is currently pending prosecution before Erie County Court Judge Susan Eagan in another criminal case. In June 2024, the defendant was arraigned on an indictment charging him with one count of Sexual Abuse in the First Degree (Class “D” felony) and one count of Assault in the Third Degree (Class “A” misdemeanor).
It is alleged that on Sunday, March 3, 2024, at approximately 10:30 p.m., the defendant, while riding a bicycle, approached the victim who was walking in Shoshone Park on the 1900 block of Hertel Avenue in the City of Buffalo. The defendant, who was not known to the victim, allegedly jumped off of his bicycle and attacked the victim. The defendant is accused of subjecting the victim to sexual contact by forcible compulsion. The victim escaped the attack and reported the incident to police.
Love is scheduled to return on both files before Judge Eagan on Friday, September 27, 2024, at 2:00 p.m. for a pre-trial conference. The defendant, who was being held on bail set at $25,000 cash, insurance company bail bond or partially secured surety bond in the sexual assault case, was held without bail in the burglary case.
Temporary orders of protection were issued on behalf of both victims.
Acting DA Keane commends the Buffalo Police Department for their work in these investigations.
The cases are being prosecuted by Assistant District Attorneys Daniel J. Mattle and Nicholas Vozzo of the Special Victims/Domestic Violence Bureau.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
