Defendant Convicted of Child Sex Abuse Receives Maximum Sentence

Erie County District Attorney Michael J. Keane announces that Robert Roy, 42, formerly of Town of Tonawanda, was sentenced this morning before State Supreme Court Justice Deborah A. Haendiges. He received the maximum sentence of 64 years to life in prison. 

On multiple occasions between on or about January 2012 and August 2018, the defendant engaged in sexual intercourse and sexual conduct with a child who was less than 13 years old. The crimes occurred at locations in the Village of Williamsville and the Town of Tonawanda. The defendant was known to the victim. 

In February 2025, a jury found Roy guilty, as charged, of two counts of Predatory Sexual Assault Against a Child (Class “A-II” felonies), one count of Criminal Sexual Act in the Second Degree and one count of Rape in the Second Degree (Class “D” felonies). Jurors rendered their decision after nearly two days of deliberation following a five-day trial, convicting the defendant of all counts in the indictment.

Today, a final order of protection was issued on behalf of the victim, which remains in effect until 2125.

The case was prosecuted by Assistant District Attorneys Rachel M. Vicario of the Special Victims/Domestic Violence Bureau and Assistant District Attorney Rachel Lewis Schepart of the Felony Trials Bureau.
