Acting Erie County District Attorney Michael J. Keane announces that Rashaan K. Mallory, 29, of Buffalo was arraigned yesterday morning before Buffalo City Court Judge Carrie Phillips on the following offenses:
- One count of Attempted Murder in the Second Degree (Class “B” violent felony)
- One count of Kidnapping in the Second Degree (Class “B” violent felony)
- One count of Assault in the First Degree (Class “B” violent felony)
- Three counts of Robbery in the First Degree (Class “B” violent felonies)
- One count of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felony)
- One count of Criminal Possession of a Weapon in the Third Degree (Class “D” felony)
- One count of Criminal Possession of a Weapon on School Grounds (Class “E” felony)
- One count of Unlawful Imprisonment in the First Degree (Class “E” felony)
- One count of Menacing in the Second Degree (Class “A” misdemeanor)
- One count of Criminal Possession of Stolen Property in the Fifth Degree (Class “A” misdemeanor)
It is alleged that on Sunday, September 15, 2024, at approximately 11:00 a.m., the defendant, while armed with an illegal weapon, forced a male victim and a female victim into a vehicle on the first block of Moselle Street in the City of Buffalo. The defendant allegedly stole the female victim’s cell phone, which prevented her from calling for help.
It is further alleged that the defendant took the victims to Emerson Park while a youth football game was underway. The defendant is accused of robbing two additional victims in the parking lot on Koons Avenue. The defendant allegedly stole a second female victim’s phone and attempted to steal chain necklaces from a second male victim while on Koons Avenue. During the robbery, the defendant allegedly attempted to cause the death of the male victim by firing several shots from the illegal gun. The victim, a 31-year-old male from Rochester, was hit twice by gunfire. The victim was taken by ambulance to ECMC where he was treated for injuries to his leg and foot.
After the shooting, the defendant allegedly drove away with the first female victim inside of the vehicle. When responding Buffalo Police officers attempted to stop the suspect vehicle on Koons Avenue and Sycamore Street, the defendant allegedly refused orders and put the vehicle into reverse in an attempt to flee, but crashed into a street sign. The defendant was taken into custody and a loaded handgun was placed into evidence.
Mallory is scheduled to return on Friday, September 20, 2024, at 9:30 a.m. for a felony hearing. He was held without bail.

The case is being prosecuted by Assistant District Attorney Timothy J. Garvin of the Major Crimes Bureau.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
