Buffalo Woman Indicted for Assaulting Jail Deputy

Erie County District Attorney Michael J. Keane announces that Dominique D. Tabb, 37, of Buffalo, has been arraigned before State Supreme Court Justice M. William Boller on an indictment charging her with one count of Assault in the Second Degree (Class “D” violent felony). The arraignment occurred on Thursday, July 10, 2025. 

It is alleged that on Sunday, July 6, 2025, at approximately 11:05 a.m., the defendant, while in custody at the Erie County Holding Center, caused physical injuries to a jail deputy. The defendant allegedly punched, kicked and stomped the victim during the attack. The victim was taken to the hospital to receive treatment for various injuries. 

Tabb was held without bail. A return court date has not been scheduled at this time. If convicted of the charge, she faces a maximum sentence of 7 years in prison. 

At the time of the alleged assault, Tabb was being held in pre-trial custody for allegedly committing two separate crimes that resulted in physical injuries to members of law enforcement. 

It is alleged that on Sunday, January 12, 2025, at approximately 6:00 p.m., Erie County Sheriff’s Office deputies stopped traffic on Touchdown Drive in the Town of Orchard Park to allow pedestrians to safely cross the roadway after a Buffalo Bills football game at Highmark Stadium. 

The defendant allegedly continued to drive her vehicle on Touchdown Drive and moved in front of another vehicle to attempt to turn onto Southwestern Boulevard. The defendant is accused of recklessly operating the vehicle by refusing multiple commands by law enforcement to stop, which endangered multiple pedestrians. The defendant allegedly hit a deputy with her vehicle and continued to drive at a rate of speed in excess of the legal limit. 

It is further alleged that when the defendant was confronted by responding deputies a short distance away, she refused commands to exit her vehicle and resisted while being placed under arrest. The defendant is accused of operating the vehicle without a valid driver’s license. 

Tabb was issued an appearance ticket. A bench warrant was issued after she failed to appear for arraignment. Tabb was returned on the bench warrant and arraigned in Orchard Park Town Court on one count of Obstruction of Governmental Administration in the Second Degree, one count of Resisting Arrest, one count of Reckless Endangerment in the Second Degree (Class “A” misdemeanors), one count of Reckless Driving, one count of Aggravated Unlicensed Operation of a Motor Vehicle in the Third (unclassified misdemeanors under New York State Vehicle & Traffic Law) and four New York State Vehicle & Traffic Law violations for speeding, failure to use the designated lane, moving unsafely from a lane, illegally driving in the center lane. Orchard Park Town Court Justice Michael Pastrick set bail at $2,500 cash or bond. Tabb is scheduled to return for further proceedings on Thursday, August 14, 2025, at 5:00 p.m.

It is alleged that on Sunday, June 8, 2025, at approximately 7:59 p.m., the defendant, with the intent to prevent a police officer from performing a lawful duty, caused physical injury to a Buffalo Police officer by biting his wrist. The alleged crime occurred on Brunswick Boulevard while the defendant was being placed under arrest for criminal mischief, harassment and endangering the welfare of a child. The defendant allegedly broke a window during an argument with the complainant, which caused more than $250 in damage. The defendant is accused of pushing a juvenile to the ground and pulling their hair during the incident. 

On June 9, 2025, Tabb was arraigned before Buffalo City Court Judge Tiffany R. Perry on one count of Assault in the Second Degree (Class “D” violent felony), one count of Criminal Mischief in the Third Degree (Class “E” felony), one count of Endangering the Welfare of a Child (Class “A” misdemeanor) and one count of Harassment in the Second Degree (violation). Our prosecutor requested that bail be set at $50,000 cash or bond. Judge Perry set bail at $15,000 cash or bond. Temporary orders of protection were issued for the civilian victim and the juvenile victim. Tabb is scheduled to return for further proceedings on Thursday, July 24, 2025, at 9:30 a.m. 

DA Keane commends the Erie County Sheriff’s Office and the Buffalo Police Department for their work in these investigations. 

The cases are being prosecuted by Chief Alicia M. Lilley of the Felony Trials Bureau, Assistant District Attorney Nathan W. Zobrest of the Justice Courts Bureau and Assistant District Attorney Nicole Crossland of the Buffalo City Court Bureau. 

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
