Buffalo Man Indicted for Fatally Shooting Victim During Attempted Burglary in City's Kensington Neighborhood

Erie County District Attorney John J. Flynn announces that 49-year-old Levon Dickson of Buffalo was arraigned yesterday before State Supreme Court Justice M. William Boller on an indictment charging him with one count of Murder in the Second Degree (Class “A-I” felony), one count of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felony) and one count of Attempted Burglary in the Second Degree (Class “D” felony). 

It is alleged that on Wednesday, February 7, 2024, at approximately 6:30 p.m., Buffalo Police responded to a reported shooting on the 300 block of Warwick Avenue where officers found a male victim suffering from gunshot wounds. The victim, 60-year-old Mitchell Reese, died at the scene. The defendant is accused of intentionally shooting the victim with an illegal gun during an attempted burglary. 

Dickson is scheduled to return on Tuesday, April 2, 2024 at 9:30 a.m. for a pre-trial conference. He remains held without bail. 

If convicted of the highest charge, Dickson faces a maximum sentence of 25 years to life in prison. 

DA Flynn commends the Buffalo Police Department for their work in this investigation. 

The case is being prosecuted by Assistant District Attorney Justin H. Caldwell of the Homicide Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
