Buffalo Man Indicted for Attempting to Injure Victim by Firing Illegal Gun in City's Broadway-Fillmore Neighborhood

Acting Erie County District Attorney Michael J. Keane announces that 25-year-old Daevon M. Roberts of Buffalo was arraigned this morning before Erie County Court Judge James Bargnesi on an indictment charging him with one count of Attempted Assault in the First Degree and one count of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felonies).

It is alleged that on Monday, April 22, 2024, at approximately 7:15 p.m., Buffalo Police officers responded to the area of Memorial Drive and Sweet Avenue for a report of shots fired. The defendant is accused of attempting to cause serious physical injuries to the victim. The defendant allegedly displayed a handgun during a verbal dispute and intentionally fired shots as the victim drove away, causing damage to the victim’s vehicle. The defendant allegedly drove away from the scene after the incident. 

Roberts is scheduled to return on Tuesday, June 18, 2024 at 9:30 a.m. for a pre-trial conference. The prosecutor requested that the defendant be held without bail. The defendant remains released under supervision. 

If convicted of the charge, Roberts faces a maximum sentence of 15 years in prison.

A temporary order of protection issued on behalf of the victim remains in effect.

The case is being prosecuted by Assistant District Attorney William Fitzgerald of the Felony Trials Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
