Buffalo Man Arraigned on Manslaughter Charge for Fatally Stabbing Victim on City's West Side

Erie County District Attorney John J. Flynn announces that 36-year-old Timothy A. Austin, also known as Khali A. Ali, of Buffalo was arraigned yesterday morning before Buffalo City Court Judge Diane Wray on one count of Manslaughter in the First Degree (Class “B” violent felony).

It is alleged that on Sunday, June 11, 2023, at approximately 1:00 p.m., Buffalo Police officers responded to a 911 call of a reported stabbing on the 400 block of Niagara Street. Police found the victim with a stab wound to his chest. The victim, 49-year-old man, was taken by ambulance to ECMC where he died from the injury. The defendant is accused of stabbing the victim during an argument.

Austin is scheduled to return on Friday, June 16, 2023 at 9:30 a.m. for a felony hearing. He was held without bail.

If convicted of the charge, Austin faces a maximum sentence of 25 years in prison.

DA Flynn commends the Buffalo Police Department Homicide Squad for their work in the investigation.  

The case is being prosecuted by Assistant District Attorney Rebecca L. Schnirel of the Homicide Unit.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
