Buffalo Man Arraigned for Assaulting Victim

Erie County District Attorney John J. Flynn announces that 35-year-old Richard C. Frazier of Buffalo was arraigned on Saturday morning before Buffalo City Court Judge Peter J. Savage, III on one count of Assault in the First Degree (Class “B” violent felony) and one count of Endangering the Welfare of an Incompetent or Disabled Person in the First Degree (Class “E” felony).

It is alleged that on April 14, 2023, at approximately 11:00 p.m., the defendant assaulted the victim by beating him repeatedly with his fists and a wooden board. The crime occurred on East Utica Street in the City of Buffalo. The victim, a 29-year-old man, was found unconscious the next morning with injuries to his head and jaw. The victim was taken by ambulance to ECMC where he remains hospitalized with serious physical injuries.

Frazier is scheduled to return on Thursday, April 27, 2023 at 9:30 a.m. for a felony hearing. He was held without bail.  

If convicted of the highest charge, Frazier faces a maximum sentence of 25 years in prison.  

Judge Savage issued a temporary order of protection on behalf of the victim.

DA Flynn commends the Buffalo Police Department for their work in this investigation.  

The case is being prosecuted by Assistant District Attorney Andres D. Ortiz of the Special Victims/Domestic Violence Bureau.  

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
