Akron Man Arraigned for Assaulting Sheriff's Deputy

Acting Erie County District Attorney Michael J. Keane announces that 26-year-old Michael A. Trybuskiewicz of Akron was arraigned yesterday morning before Newstead Town Court Justice Dennis R. Freeman on one count of Assault in the Second Degree, one count of Reckless Endangerment in the First Degree (Class “D” violent felonies), one count of Unlawful Fleeing a Police Officer in a Motor Vehicle in the Third Degree, one count of Obstruction of Governmental Administration in the Second Degree, one count of Resisting Arrest (Class “A” misdemeanors) and several violations under New York State Vehicle & Traffic Law. 

It is alleged that on Tuesday, May 14, 2024, at approximately 4:30 p.m., an Erie County Sheriff’s Office deputy saw the defendant, who was wanted on an arrest warrant, driving at the intersection of Route 93 and Route 5 in the Town of Newstead. When the deputy approached the vehicle, the defendant allegedly refused the deputy’s commands and placed the vehicle into drive in attempt to flee. The defendant’s alleged actions caused the deputy to be dragged by the vehicle as he drove away. The victim was taken by ambulance to Millard Fillmore Suburban Hospital where he was treated for injuries to his head, shoulder, ankle and elbow. The defendant was later taken into custody by the Genesee County Sheriff’s Office. 

Trybuskiewicz has another criminal case pending in Newstead Town Court. It is alleged that on Saturday, March 30, 2024, the defendant, with the intent to harass or annoy, called the male victim and left a voicemail, which threatened the victim and his wife. On Monday, April 1, 2024, the victim allegedly listened to the voicemail and then reported the incident to police. The defendant’s alleged actions placed the victim in reasonable fear of harm.

It is further alleged that on Monday, April 1, 2024, at approximately 9:22 a.m., an Erie County Sheriff’s Office deputy was initiating a traffic stop to arrest the defendant on an aggravated harassment charge. The defendant alleged refused to stop his vehicle as the deputy, who was in a marked patrol vehicle with the emergency lights activated, attempted to make a lawful stop on Cummings Road in the Town of Newstead. The defendant was taken into custody and arraigned the following morning. 

On Tuesday, April 2, 2024, Trybuskiewicz was arraigned before Newstead Town Court Justice Dennis R. Freeman on one count of Aggravated Harassment in the Second Degree, one count of Resisting Arrest, and one count of Obstruction of Governmental Administration in the Second Degree (Class “A” misdemeanors). He was released on his own recognizance as the charges are non-qualifying offenses for bail. Temporary orders of protection were issued on behalf of both victims.

Following his arraignment in the alleged threat case, the defendant is accused of leaving two threatening voicemail messages to Newstead Town Court on Thursday, April 25, 2024 and Friday, May 3, 2024, which placed a court employee in reasonable fear of harm. A warrant was issued for his arrest on Thursday, May 9, 2024.

Trybuskiewicz was also arraigned yesterday morning before Judge Freeman on one count of Aggravated Harassment in the Second Degree (Class “A” misdemeanor) and one count of Making a Threat of Mass Harm (Class “B” misdemeanor). Today, a temporary order of protection was issued on behalf of the town court employee. 

Trybuskiewicz is scheduled to return on all three cases on Monday, May 20, 2024 at 9:30 a.m. for a felony hearing. He was held without bail. 

If convicted of the highest count, Trybuskiewicz faces a maximum sentence of 7 years in prison.

The cases are being prosecuted by Assistant District Attorney Anthony J. Campanella of the Justice Courts Bureau. 

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
