Mario A. Giacobbe

Mario Giacobbe was sworn into office by District Attorney Flynn in August 2021. Giacobbe replaced former Deputy District Attorney William F. Coughlin who retired after 24 years of practice in criminal law. Coughlin, a former prosecutor and public defender, served as the Deputy District Attorney-Executive Assistant for over four years, beginning when Flynn took office in January 2017.

Giacobbe left private practice as a partner in The Law Offices of Jaworski & Giacobbe to serve as a member of Flynn’s leadership team. Since July 2006, his work primarily focused on Driving While Intoxicated cases and other criminal defense matters. Giacobbe has extensive civil trial practice experience, including personal injury, real estate, estate litigation, matrimonial, and family law.

Giacobbe previously served as a prosecutor in the Erie County District Attorney’s Office. During his nearly 12 years as an Assistant District Attorney, he prosecuted and supervised thousands of criminal cases. He also served as the Chief of the former DWI Bureau (now the Vehicular Crimes Unit), responsible for overseeing all driving while impaired cases from 2000 through 2005. 

Giacobbe was appointed as the Town Prosecutor (2006-2021) and Town Attorney (2017-2021) in the Town of Tonawanda, positions he held until being selected to serve as a Deputy District Attorney.

In addition, Giacobbe is a member of the Bar Association of Erie County and serves on the organization’s Board of Directors. He was chosen to lead the WNY Prosecutors Association as president in 2017, an organization he joined in 2006.

Giacobbe graduated from Canisius College with a Bachelor of Arts degree in 1988. He received his Juris Doctor degree from Cleveland-Marshall College of Law in 1991.
