Erie County District Attorney John J. Flynn announces that 35-year-old Anthony B. Hicks of Buffalo has been sentenced by State Supreme Court Justice M. William Boller to a determinate sentence of 7 years in prison followed by 5 years of post-release supervision.

On the evening of November 11, 2018, Buffalo Police officers responded to the area of Broadway and Lathrop Street to investigate a shots fired call near a nightclub. Police found the defendant in possession of a gun that was located in his waistband.

The defendant admitted to possessing an illegal, operable firearm. Hicks pleaded guilty, as charged, to one count of Criminal Possession of a Weapon in the Second Degree on July 22, 2019.

Hicks was out of custody on bail when he appeared in court on September 27, 2019 for sentencing. He requested an adjournment, which was denied by Justice Boller. The defendant then left the courthouse and a bench warrant was issued for his arrest.

Hicks was located and taken into custody on Thursday, August 27, 2020 by the U.S. Marshals Service.

DA Flynn commends the Buffalo Police Department for their work in the investigation. He also commends the U.S. Marshals Service for locating the absconder.
