ORIGINAL PRESS RELEASE (October 13, 2020):
Erie County District Attorney John J. Flynn announces that 43-year-old David Miszko of Buffalo has been arraigned before Erie County Court Judge James Bargnesi on an indictment charging him with one count of Murder in the Second Degree, a Class “A-I” felony.
It is alleged that on September 13, 2020, at approximately 10:30 p.m., the defendant fatally stabbed 34-year-old Richard D'Andrea in the vicinity of Spann Street in the City of Buffalo.
Miszko was held without bail. A return court date has not been scheduled at this time.
If convicted of the charge, Miszko faces a maximum of 25 years to life in prison.
DA Flynn commends the Buffalo Police Department Homicide Unit for their work in the investigation.
The case is being prosecuted by Assistant District Attorney Ashley M. Morgan of the DA’s Homicide Unit.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
