Erie County District Attorney John J. Flynn announces that 42-year-old Tony M. Gregory, II of Buffalo has been arraigned before Buffalo City Court Judge Shannon M. Heneghan, acting as a West Seneca Town Justice, on two counts of Forcible Touching and three counts of Endangering the Welfare of a Child, Class “A” misdemeanors.
It is alleged that on or about October and November of 2018, the defendant, who was employed as a teacher at Erie 1 BOCES in West Seneca, forcibly touched the intimate parts of a student who was under the age of 18-years-old at a location in the Town of West Seneca. The defendant is also accused of displaying a naked image of himself to the student during school.
Gregory is scheduled to return to West Seneca Town Court on Tuesday, November 17, 2020 at 9:30 a.m. for further proceedings. Judge Heneghan set bail at $25,000 cash, $35,000 bond, or $35,000 partially secured bond.
If convicted on all charges, Gregory faces up to two years in jail.
Judge Heneghan issued an order of protection of behalf of the victim.
DA Flynn commends Det. Lt. William Leitzel and Det. Anthony Serafini of the West Seneca Police Department for their work in the investigation.
The case is being prosecuted by Assistant District Attorney Stephen C. Earnhart of the DA’s Special Victims Bureau.
As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
