Erie County District Attorney John J. Flynn announces that State Supreme Court Justice Paul B. Wojtaszek has found 57-year-old Mark Dublino of Cheektowaga guilty of one count of Assault in the Second Degree (Class “D” violent felony). The defendant was convicted of the highest count in the indictment against him.

Justice Wojtaszek rendered his decision this morning following a seven-day bench trial that began on March 30, 2021. Judge Wojtaszek found the defendant not guilty of the second count of the indictment, one count of Attempted Assault in the Second Degree (Class “E” felony).

On Friday, March 9, 2018, at approximately 10:30 a.m., the defendant attacked his defense attorney during a scheduled meeting inside the Erie County Holding Center on Delaware Avenue in the City of Buffalo. The defendant punched the victim in the face numerous times before Erie County Sheriff’s deputies were able to intervene. The attorney suffered significant facial injuries.

Dublino faces a maximum of 7 years in prison when he is sentenced on Thursday, July 1, 2021 at 11:00 a.m. He remains held without bail.

“This defendant attacked his defense attorney while receiving legal advice in criminal matter. His violent actions are completely unacceptable. His conviction today is further proof that this defendant is a dangerous individual and should remain incarcerated,” said Erie County District Attorney John J. Flynn. “I will continue to prosecute anyone initiates violence at the Holding Center or other jails in Erie County.”

Dublino is currently serving a sentence of 107 years in prison after a jury convicted him of two counts of Attempted Murder in the Second Degree and numerous felony charges in a separate case for attacking his ex-girlfriend and two other people in June 2016.

The case was prosecuted by Assistant District Attorneys James Marra and Nicholas A. Bussi of the DA’s Felony Trials Bureau.
