Buffalo Man Indicted for Attempting to Kill His Estranged Wife, Fatally Inuring the Victim's Father During the Attack

Erie County District Attorney John J. Flynn announces that 39-year-old Mohammed Mia of Buffalo was arraigned this morning before Erie County Court Judge Kenneth Case on an indictment charging him with the following offenses:

  • Two counts of Murder in the Second Degree (Class “A-I” felony)
  • Three counts of Burglary in the First Degree (Class “B” violent felony)
  • One count of Attempted Murder in the Second Degree (Class “B” violent felony)
  • One count of Aggravated Criminal Contempt (Class “D” felony)
  • One count of Assault in the Third Degree (Class “A” misdemeanor)

It is alleged that on October 24, 2021, at approximately 8:30 a.m., the defendant unlawfully entered the home of his estranged wife, knowingly in violation of an order of protection with the intent to commit a crime, on Manhart Street in the City of Buffalo. Once inside the house, the defendant allegedly attempted to intentionally cause the death of his estranged wife by slapping, punching and choking the victim. The defendant allegedly threatened to kill the victim during the attack.

The defendant is also accused of causing physical injuries to the victim’s parents as they attempted to intervene. The defendant allegedly punched and kicked the victim’s father repeatedly after throwing him to the floor. The defendant is accused of punching and slapping the victim’s mother.

After the defendant allegedly fled in his vehicle, the victim called 911 to report the crime.

When paramedics arrived, the victim’s father was unconscious. He was taken to ECMC with severe head trauma. The victim and her mother were also taken to ECMC to be treated for cuts and bruises to their face and body as well as broken teeth.

The defendant was taken into custody later that day after he allegedly went to the E-District police station to report that he had been attacked by the victims.

The defendant was initially charged with multiple offenses, including burglary, aggravated criminal contempt, assault and endangering the welfare of a child. He was arraigned in Buffalo City Court on October 25, 2021. He was held on $25,000 bail. He was scheduled to return on October 29, 2021 for a felony hearing.

The victim’s father, 47-year-old Mohammed Hossain, died from his injuries on October 27, 2021. The victim’s funeral was held two days later. Subsequently, the defendant’s felony hearing was adjourned for good cause and re-scheduled for November. The case was presented to a Grand Jury prior to the felony hearing and the defendant was indicted on seven felony charges and one misdemeanor charge for his alleged crimes.

Mia is scheduled to return on Tuesday, December 21, 2021 at 9:30 a.m. for a pre-trial conference. He was held without bail.

At the request of prosecutors, Judge Case issued a temporary order of protection on behalf of the victims that remains in effect for one year.

If convicted of all charges, Mia faces a maximum of 25 years to life in prison. 

The defendant also has a pending case in Buffalo City Court for a domestic violence-related incident involving the same female victim. The victim filed a police report after the defendant allegedly threatened to kill her on September 10, 2021.

Mia was arraigned on one count of Harassment in the Second Degree (violation) before Buffalo City Court Judge Shannon M. Heneghan on September 12, 2021. Judge Heneghan issued an order of protection on behalf of the victim, which ordered the defendant to stay away from the victim and her home. The defendant is accused of violating that order of protection when he allegedly went to the victim’s home committed the attack on October 24, 2021.

DA Flynn commends the Buffalo Police Department Homicide Squad for their work in the investigation.

The case is being prosecuted by Chief Gary W. Hackbush of the Homicide Unit and Assistant District Attorney Amanda L. Raimondi of the Special Victims/Domestic Violence Bureau.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
