Erie County District Attorney John J. Flynn announces that 27-year-old Daiquin Gray of Buffalo was arraigned this morning before Erie County Court Judge Sheila A. DiTullio on an indictment charging him with the following offenses:

• One count of Murder in the First Degree (Class “A-I” felony)
• One count of Murder in the Second Degree (Class “A-I” felony)

It is alleged that on April 24, 2021, at approximately 6:09 p.m., the defendant and another individual approached the victim from behind, with the intent to commit a robbery, outside of a gas station on East Delavan Avenue and Grider Street in the City of Buffalo. The alleged incident occurred as the victim was pumping gas into his vehicle.

The defendant, while acting in concert with another person, is accused of intentionally firing multiple shots at the victim during the commission of the robbery. The victim attempted to flee the attack, but collapsed nearby. When the victim fell to the ground, the defendant allegedly stole the victim’s gold chain necklace from his neck.

The victim, 38-year-old Marcques Robinson of Buffalo, died from his injuries.

Gray was held without bail. A return court date has not been scheduled at this time.

If convicted of all charges, Gray faces a maximum of life in prison without parole.

DA Flynn commends the Buffalo Police Department for their work in the investigation.

The case is being prosecuted by Assistant District Attorney Ryan D. Haggerty of the Homicide Unit.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
