Erie County District Attorney John J. Flynn announces that 50-year-old Robert F. Dinero of Orchard Park was arraigned yesterday afternoon before Orchard Park Village Justice Edward A. Pace on two counts of Criminal Trespass in the Third Degree (Class “B” misdemeanors).

It is alleged that on December 9, 2021, at approximately 5:56 p.m., the defendant knowingly entered and unlawfully remained inside Orchard Park Middle School in violation of regulations governing entry of the school building. The alleged incident occurred after the Orchard Park Central School District notified the defendant that he was prohibited from entering any school building following a violation of the district’s Code of Conduct.

It is further alleged that on December 14, 2021, at approximately 7:11 p.m., the defendant knowingly and unlawfully entered a second district building, Orchard Park High School, in violation of the regulations governing entry.

Dinero is scheduled to return on Tuesday, March 15, 2022 at 4:00 p.m. for further proceedings. The defendant was released on his own recognizance as the charge is non-qualifying for bail. Justice Pace ordered the defendant to stay away from all district buildings except when transporting his children to school.

If convicted of all charges, Dinero faces a maximum sentence of three months in jail.

DA Flynn commends the Orchard Park Police Department for their work in these investigations.

Both cases are being prosecuted by Assistant District Attorney Ashmita Roka of the Justice Courts.

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
