Erie County District Attorney John J. Flynn announces that 29-year-old Elmarious E. Honeycutt of Buffalo was sentenced yesterday afternoon before Erie County Court Judge Suzanne Maxwell Barnes to a determinate sentence of 12 years in prison followed by 5 years of post-release supervision. He was sentenced as a second violent felony offender.

On July 14, 2019, at approximately 10:45 a.m., the defendant contacted the victim through social media to arrange a meeting to exchange marijuana. Approximately 30 minutes later, the victim and his girlfriend drove to meet the defendant on Durham Street in the City of Buffalo.

A struggle ensued after the defendant got into the backseat of the victims’ vehicle, which resulted in the male victim being shot in the neck. After the shooting, the defendant fell out of the vehicle, recovered the handgun and ran away from the scene, which was supported by video evidence. The girlfriend drove to ECMC where the male victim was treated for the injury to his neck.

A jury found Honeycutt guilty of one count of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felony) on March 4, 2022. He was acquitted of all other charges against him. The jury rendered their decision after nearly four hours of deliberation following a 2 ½ day trial.
