Erie County District Attorney John J. Flynn announces that 33-year-old Devin D. Brown of Concord, North Carolina was arraigned yesterday afternoon before Erie County Court Judge Suzanne Maxwell Barnes on an indictment charging him with two counts of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felonies).

It is alleged that on Tuesday, April 5, 2022, at approximately 6:44 p.m., the victim was sitting on the porch of a residence on Millicent Avenue in the City of Buffalo when she saw the defendant urinating on the side of the home. A verbal altercation ensued when the victim allegedly confronted the defendant. During the argument, the defendant allegedly pulled out what appeared to be a handgun and waved it in the air. It is further alleged that the defendant walked to his vehicle and displayed what appeared to be a second, larger firearm. The alleged incident occurred in the presence of three children.

Buffalo Police responded to investigate the complaint and approached the defendant about the reported incident. During the investigation, officers allegedly recovered a loaded, illegal handgun from inside the defendant’s pocket. Police also allegedly recovered an illegal, loaded semi-automatic rifle found in plain view on the backseat of the defendant’s vehicle.

Brown is scheduled to return on Monday, September 12, 2022 at 2:00 p.m. for motions. Judge Maxwell Barnes increased the defendant’s bail from $7,500 set in Buffalo City Court to $50,000 cash, bond or partially secured bond.

If convicted of the charges, Brown faces a maximum sentence of 15 years in prison.

The case is being prosecuted by Assistant District Attorney Briana R. D. Miller of the Felony Trials Bureau.  

As are all persons accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
