Erie County District Attorney Frank A Sedita, III announced today that 25 year old Antonio Davis pleaded guilty, as charged, to Criminal Possession of a Weapon in the Second Degree, before Senior Erie County Court Judge Michael D’Amico. This is the highest charge for which the defendant could have been convicted had he gone to trial. The defendant’s plea to the highest possible charge is another example of the Erie County District Attorney’s Office no reduced plea policy in gun cases. Davis was arrested on March 15, 2011 by officers of the Buffalo Police Department after a foot chase. The defendant was on parole when arrested. The defendant’s first felony conviction occurred when he was 17 years old. This, his latest conviction, is his fifth felony conviction overall in the last eight years. Accordingly, the Office of the Erie County District Attorney will seek that defendant be sentenced as a Persistent Violent Felony Offender, which would make him eligible for a sentence of 16 years to life in state prison, when he is sentenced on Feb. 10, 2012 at 9:30 AM.
