Tonawanda Man Admits to Stealing Over $366,000 From Employer

Erie County District Attorney Frank A. Sedita, III announced that 61 year old David Denue of 135 Irving Terrace, Tonawanda, pleaded guilty late yesterday afternoon to Grand Larceny in the Second Degree and Repeated Failure to File an Income Tax Return before County Court Judge Thomas P. Franczyk.  These are the highest charges for which the defendant could have been convicted had he gone to trial. 

Denue admitted that during the period between January 1, 2005 and May 30, 2011, in his position of financial trust while employed with ESCO Forest Products of Boynton Beach, Florida, he stole a total of $366,680 by filing falsified internal business records.  Additionally, Denue failed to file personal income tax returns with New York State for tax years 2005 – 2010, resulting in a liability of $23,230.

Sentencing is scheduled for May 23, 2012, at 9:30 a.m. before the Hon. Thomas P. Franczyk when Denue faces a maximum prison sentence of 19 years.
