District Attorney Frank A. Sedita, III announced that 58 year-old Alfred Mack of Dewey Avenue was found guilty, as charged, of Burglary in the Second Degree and Criminal Contempt in the First Degree, both felonies, after a week-long jury trial.

Mack was the subject of a February 27, 2012 Buffalo City Court Order of Protection directing him to stay away from his girlfriend. One week later and in disobedience of that court order, the defendant climbed through his girlfriend’s window and began to assault her. The attack was interrupted when neighbors intervened. Mack was arrested outside in an attempt to flee the scene.

Mack testified on his own behalf, claiming that he was not paying attention when the judge, on February 27^th, ordered him to stay away from the victim. Mack also claimed that he had permission to enter the victim’s home by climbing through the window at night. The trial jury apparently rejected the defendant’s ludicrous claims by returning a guilty verdict.

DA Sedita lauded the efforts of his trial prosecutors, Domestic Violence Bureau Chief Rachel Newton and ADA Alicia Lilley, stating: “As was demonstrated by the recent jury trial conviction of Eli Casillas--who was found guilty of assaulting and strangling his pregnant girlfriend--and as is again demonstrated by this conviction, the Erie County District Attorney’s Office will continue to aggressively prosecute those who commit criminal acts of domestic violence.”

Mack, a prior felon, has an extensive criminal history and has been incarcerated since his arrest on March 7, 2012.  Mack faces a maximum of 15 years in state prison when sentenced on May 16, 2013 at 2:00 PM before State Supreme Court Justice Deborah A. Haendiges.
