Erie County District Attorney Frank A. Sedita, III announced that 32 year-old Gerald Hogue was convicted, as charged, of Criminal Possession of a Weapon in the Second Degree on March 19th before County Court Judge Michael Pietruszka after a week-long jury trial.

Hogue’s conviction stems from the August 14, 2011 possession of a loaded .38 caliber  handgun after officers responded to a disturbance at Davidson and Suffolk Streets in the City of Buffalo.  The investigation determined that Hogue possessed the weapon and then passed it to his co-defendant, Cynthia Holes.  Holes was previously convicted of Criminal Possession of a Weapon in the Second degree after a non-jury trial before the Hon. Michael Pietruszka on December 13, 2012. 

Roosevelt faces a maximum prison term of 15 years when he is sentenced before the Hon. Michael Pietruszka on June 2, 2013 and Holes also faces a maximum prison term of 15 years when she is sentenced on April 5, 2013.  The case was tried by Assistant District Attorney Eugene T. Partridge, III.
