Erie County District Attorney Frank A. Sedita, III announced that 23 year-old Daniel Burnett of 79 Grape Street, Buffalo, pleaded guilty as charged to Criminal Possession of a Weapon in the Second Degree before Supreme Court Judge Penny M. Wolfgang.  This is the highest charge for which Burnett could have been convicted had he gone to trial. 

Burnett’s conviction stems from the October 5, 2012 arrest where he was found in possession of a .22 caliber revolver on Rodgers Street in the City of Buffalo.  Buffalo Police were on the look-out for a person who brandished a gun while threatening a woman approximately ten minutes prior to Burnett’s arrest.  DA Sedita praised the efforts Buffalo Police Officers Michael Acquino and Mark Hamilton for quickly locating Burnett and recovering the concealed weapon from Burnett’s pants pocket.

The case was successfully prosecuted by ADA John Gerken. Burnett faces a maximum prison term of 15 years when he is sentenced before the Honorable Penny M. Wolfgang on May 22, 2013 at 9:30a.m.
