Erie County District Attorney Frank A. Sedita, III announced that 32 year old Tammy Karek of 163 Eden Street, Buffalo, pleaded guilty, as charged, to Feloniously Driving While Intoxicated and Leaving the Scene of an Accident before Supreme Court Justice M. William Boller. These are the highest charges for which she could have been convicted had she gone to trial.
This is Karek’s third arrest for drunken driving; she has previously been convicted of Driving While Ability Impaired and misdemeanor level Driving While Intoxicated. In this case, Karek admitted that on January 28, 2013, on Potters Road in West Seneca, she struck a vehicle driven by 93 year old Carl Dimmig and his 88 year old passenger and wife, Ruth Dimmig, as they were turning into their driveway. Minor injuries were sustained by both. Karek attempted to flee the scene but was quickly apprehended by the West Seneca police. Karek’s breath alcohol content was 0.15%, nearly twice the legal limit.
The case was successfully prosecuted by ADA Robin Deubler, who is assigned to DA Sedita’s Vehicular Crimes Bureau. Karek faces a maximum prison sentence of 4 years in state prison when she is sentenced on December 6, 2013 at 9:30 a.m. before Justice Boller.
