Erie County District Attorney Frank A. Sedita, III announced that 42 year-old William Kuhn of 41 Stoneleigh Avenue, Town of Tonawanda, pleaded guilty, as charged, this afternoon to Disseminating Indecent Material to Minors in the Second Degree before County Court Judge Kenneth F. Case.  This is the highest charge for which he could have been convicted had he gone to trial. 

Kuhn was employed as teacher and music band director at Kenmore Middle School.  With his adoring and apparently very forgiving spouse at his side, Kuhn admitted that he used his cellphone to send a photo of his naked genitalia to a fourteen year old student in April of 2013.   As conditions of his plea, DA Sedita required Kuhn to resign from his teaching position at the Kenmore-Town of Tonawanda Union Free School District and to surrender his teaching certificate to the New York State Education Department.  

The case was successfully prosecuted by Rosanne E. Johnson, Chief of DA Sedita’s Special Victims Bureau. DA Sedita praised the efforts of his prosecutor, as well as that of Town of Tonawanda Detectives William Fleming, William Krier, and William Smith, stating: “Because of their professional investigation, a deviant will no longer have the opportunity to teach and target school-children.”

Kuhn faces a maximum prison term of 1-1/3 to 4 years when he is sentenced before Judge Case on October 24, 2013 at 9:30 a.m.
