Erie County District Attorney Frank A. Sedita, III announced that 33 year old Shawn McIntosh of 308 Parkhurst, Tonawanda, pleaded guilty, as charged, to the following crimes before Erie County Court Judge Kenneth F. Case: four counts of Use of a Child in a Sexual Performance; two counts of Sexual Abuse in the First Degree; four counts of Possessing a Sexual Performance by a Child; and, two counts of Endangering the Welfare of a Child. These are the highest charges for which McIntosh could have been convicted had he gone to trial.
McIntosh admitted to the following: to taking pornographic photographs of two girls under the age of eleven; to subjecting both children to sexual contact with a gelatinous penis-shaped device or “dildo”, as it is known colloquially; and, to possessing four additional images of child pornography. These crimes occurred from September of 2011 through January of 2012.
The case was successfully prosecuted by ADA Peter J. Marche of DA Sedita’s Special Victims Bureau. DA Sedita also recognized efforts of the Town Detective William Fleming--who conducted a forensic analysis of two computers in the defendant’s possession--as well as his fellow officers and detectives in the Town of Tonawanda Police Department, stating: “Because of their diligence, another disgusting degenerate has been prosecuted to the fullest extent of the law.”
McIntosh faces a maximum prison sentence of up to 50 years when he is sentenced before Judge Case on November 1, 2013.
