Erie County District Attorney Frank A. Sedita III announced that 48 year-old Eric Davis of 1600 Bailey Avenue, Buffalo, was sentenced today by State Supreme Court Russell P. Buscaglia to 15 years in prison followed by 5 years of post-release supervision for his conviction of Attempted Assault in the First Degree. On November 15, 2013, Davis pleaded guilty to repeatedly striking his downstairs neighbor about the head with a claw hammer on September 4, 2013. Robbery was the principal motive for the assault.
Discovered by his landlord five days later, the 54 year-old victim suffered a stroke from his untreated injuries. Davis repeatedly went inside the victim’s apartment to steal property throughout the five days and never summoned help for the suffering victim.
No stranger to the criminal justice system, Davis cited his cocaine addiction and asked the court to grant him leniency, despite the ferocity of this felonious assault, as well as his felony assault conviction from 1994 and his felony assault conviction from 2004. He instead received the maximum.
The case was successfully prosecuted by Assistant District Attorney Michael P. Felicetta, who is assigned to DA Sedita’s Tactical Prosecution Unit.
