Erie County District Attorney Frank A. Sedita, III announces that 33 year- old Brian Myles of 233 Parkside Avenue, Buffalo, pleaded guilty, as charged, to two counts of Driving While Intoxicated before State Supreme Court Justice M. William Boller. These are the highest charges for which Myles could have been convicted had he gone to trial. In other words, Myles was prosecuted to the fullest extent of the law.

Myles’ convictions stem from two separate incidents, both of which occurred on Main St. 

On October 19, 2013, Amherst Police Officers stopped Myles because he was driving in the opposite lane of travel on Main St., near the University of Buffalo campus. When questioned, Myles’ speech was incomprehensible and he needed assistance standing. Myles was given six field sobriety tests and failed all of them. He refused to take the Breathalyzer test.

On December 25, 2013 at approximately 4:50 AM, NFTA Police Officers stopped Myles’ vehicle because he was repeatedly making U-turns on Main St., near Ferry, in the City of Buffalo. Despite great difficulty standing and speaking, Myles’ was heard to explain that his repeated U-Turns were made in an effort to locate a nearby McDonald’s restaurant. Myles was given four field sobriety tests and failed all of them. Once again, he refused to take the Breathalyzer but this time suggested that perhaps he deserved a break today.

Myles has previously been convicted of Driving While Intoxicated and Driving While Ability Impaired and faces up to four years in state prison when he is sentenced on May 30, 2014 at 9:30 a.m. by Justice Boller. 

The case was successfully prosecuted by Assistant District Attorney Robin J. Deubler, who is assigned to DA Sedita’s Vehicular Crimes Bureau.
