Erie County District Attorney Frank A. Sedita III announced that 50 year-old Larry Brooks of 373 Moselle Street, Buffalo, has pleaded guilty as charged to Assault in the First Degree before Erie County Court Judge Sheila A. DiTullio. This is the highest charge for which the defendant could have been convicted had he gone to trial.  In other words, he was prosecuted to the fullest extent of the law. 

On August 7, 2013, Brooks shot the victim with, shockingly, an illegal handgun. In yet another startling co-incidence, Brooks has a previous conviction for Felonious Assault. Brooks is therefore a Second Violent Felony Offender and faces a minimum of ten years and a maximum of twenty-five years in state prison when he is sentenced on April 25, 2014 at 9:30am by Judge Ditullio.
