District Attorney Frank A. Sedita, III announces that 52 year-old Robert Smith of 106 Dodge Street, Buffalo, will be arraigned at 2:00 p.m. before Erie County Court Judge Kenneth F. Case on an indictment charging him with Murder in the Second Degree.

It is alleged that on March 5, 2015 at 106 Dodge Street, Buffalo, Smith murdered his live-in girlfriend and mother of his daughter, 53 year-old Diane Demps, by beating her. 

If convicted of this crime, Smith faces a maximum prison sentence of 25 years to life. 

Like all defendants accused of a crime, the defendant is presumed innocent until proven guilty in a court of law.
