Erie County District Attorney Frank A. Sedita, III announces that, after nearly five years of obdurate litigation, the guilty verdicts of Beth Hoskins were affirmed on appeal by Erie County Court Judge Michael F. Pietruszka.

Hoskins was originally charged with multiple counts of animal cruelty in March 2010. After more than two years of procuring adjournments, filing motions, and accusing both the SPCA and Erie County District Attorney’s Office of misconduct, Hoskins finally stood trial before Aurora Town Justice Edward Marky. After fourteen months of trial, Hoskins was found guilty of 52 counts of animal cruelty.

Despite her dilatory tactics and the fact she stood convicted as the most prolific animal abuser in the modern history of Erie County, Hoskins was sentenced to probation and community service. Shockingly, Hoskins soon violated her probation, which resulted in the imposition of a 90 day jail sentence by Judge Marky.

The case was successfully prosecuted by Assistant District Attorney G. Michael Drmacich, Chief of DA Sedita’s Community Prosecution Bureau. Assistant District Attorney Nicholas Texido, who is assigned to DA Sedita’s Appeals Bureau, responded to the defendant’s 152 page appellate “brief” and successfully defended the conviction.
