Gunman and Carjacker Prosecuted to Fullest Extent of the Law

Erie County District Attorney Frank A. Sedita III announces that 30 year-old Kevin Dogan of Military Road in the City of Buffalo pleaded guilty as charged to Assault in the First Degree and three counts of Robbery in the First Degree before Erie County Court Judge Michael Pietruszka. These are the highest charges for which the defendant could have been convicted had he gone to trial. In other words, Dogan did not receive a so-called “plea bargain” and was prosecuted to the fullest extent of the law.

On December 18, 2013, Dogan shot one man in the face on Pennsylvania Street. Dogan fled the crime scene and attempted to carjack a couple, at gun point, on Fargo Avenue. When Dogan could not drive the couple’s vehicle because of his inability to work a manual transmission, he stole their cellphone to prevent them from calling police. Dogan continued his crime spree by stealing a delivery truck, again at gun point, from a FedEx employee delivering Christmas gifts on Fargo Avenue. Dogan fled in the truck, eventually abandoning it on West Avenue. Buffalo Police Officers finally caught Dogan attempting to break into another home on Forest Avenue.

No stranger to the criminal justice system, Dogan previously served a state prison sentence for a residential burglary. Consequently, Dogan faces a minimum of 10 years and a maximum of 50 years upon his much deserved return state prison when he is sentenced by Judge Pietruszka on June 15, 2015.  

The case was successfully prosecuted by Assistant District Attorney James R. Gardner, who is assigned to DA Sedita’s Felony Trial Bureau and Assistant District Attorney Paul E. Bonanno, Chief of DA Sedita’s Financial Crimes Bureau.
