Acting Erie County District Attorney Michael J. Flaherty, Jr. announces that 30-year-old Carl Nye, III of Buffalo was sentenced today to six months in the Erie County Correctional Facility in Alden by Erie County Court Judge Kenneth Case.

The prison sentence will be followed by five years probation and 200 hours of community service.

In October 2015, Nye pleaded guilty as charged to Leaving the Scene of an Incident without Reporting Resulting in Serious Physical Injury.  This was the highest charge for which the defendant could have been convicted had the case gone to trial.

Nye was driving when he struck 52-year old Adam Brown of Metairie, Louisiana on May 8, 2015 at 7:45 p.m., as Brown crossed Elmwood Avenue near the LA Fitness gym in North Buffalo.  Nye sped off, but due to the quick efforts by the Buffalo Accident Investigation Unit and a tip by a concerned citizen, Nye’s damaged vehicle was found an hour later in South Buffalo where he attempted to hide it.

The victim, as a result of being struck, suffered a severe leg injury and head trauma, spending several months in a rehabilitation center.

The case was successfully prosecuted by Assistant District Attorney Christopher M. McCarthy of the Erie County District Attorney’s Vehicular Crimes Bureau.

Acting DA Flaherty added, “Once again, the professional, thorough and expedient investigation by the members of the Buffalo Police Department provided our office with the evidence needed to prosecute this defendant to the fullest extent of the law.”
