Buffalo Heroin Dealer Sentenced To Six Years In Prison

Acting Erie County District Attorney Michael J. Flaherty, Jr. announces that 33 year old Brian Gerena of 1250 West Avenue in Buffalo has been sentenced to six years in prison and 3 years post-release supervision by Erie County Court Judge Sheila DiTullio.

On August 10, 2015, the defendant pleaded guilty to a six count indictment charging him with two counts of Criminal Sale of a Controlled Substance in the 3rd Degree, three counts of Criminal Possession of a Controlled Substance in the 3rd Degree and one count of Criminal Possession of a Controlled Substance in the 4TH Degree.

The indictment involved three separate incidents.  On both October 24, 2014 and November 10, 2014, the defendant sold two bundles of heroin to an undercover officer. 

On December 2, 2014, based on the previous sales, police executed a search warrant at the defendant's residence and recovered over a 1/8 ounce of heroin. 

Acting DA Flaherty credits the DEA Task Force, the Buffalo Police Department and the Cheektowaga Police Department for their thorough investigation.

Assistant District Attorney Brian Langenfeld prosecuted the case.
