Acting Erie County District Attorney Michael J. Flaherty, Jr. announces that 49-year-old John Battaglia of North Tonawanda has been sentenced to six years in jail by Erie County Court Judge Kenneth F. Case and his stepson, 26-year old Kyle Wade of Tonawanda received five years probation from State Supreme Court Justice Penny M. Wolfgang after pleading guilty to burglary charges. 

Battaglia and co-defendant 49-year-old James Baglio of Depew burglarized many homes in Erie, Niagara and Genesee Counties in September and October of 2015, stealing a large number of firearms and jewelry.  Wade admitted to burglarizing a home in Lancaster with Baglio in October of 2015. 

Battaglia pleaded guilty to two counts of Burglary in the Second Degree. Wade pleaded guilty to one count of Attempted Burglary in the Second Degree. 

Baglio pleaded guilty to five counts of Burglary in the Second Degree and one count of Robbery in the Second Degree and was sentenced to eight years in prison.

Acting DA Flaherty commends Investigators Ron Wilson and Alan Harshany from the New York State Police and Detectives Matthew Noecker, John Graham and Greg McCarthy of the Erie County Sheriff’s Office who spent long hours on this case. 

Paul J. Glascott, Chief of DA Flaherty’s Felony Trials Bureau prosecuted the burglary cases.
